Abstract:
Ownership in its most comprehesie significance denotes the relations between a person and any right that is vested in him. the ownership elements of land comprises the right to control, possess, enjoy and dispose of land not contrary to law. The right of ownership is only capable of being exercised by he who has the legal title to the land as evidenced by the registration of titles under torrenSystems is briefly described in Chapter Two. The intrinsic rights of ownership capable of being exercised by the landowner are further subject to public land legislation which are upheld by the law for innumerable reasons external to landownership such as planning control, public health, water conseration, popular recreation or national defence. Chapters Two, Three and Four thus go on to examine the implication of the legal framework of land upon three major elements of private land ownership viz, (a) the right to the use of the land (b) the right to deal with land i.e. to transfer, charge, lease etc. (c) the right to develop the land . Findings and conclusion drawn through information gathered and analysis made are submitted after each Chapter. This proprietary right of the landowner is however capable of being acquired by the Authorities in the interest of the community as a whole. The extent to which the landowner is adequately compensated for the deprivation is examined in Chapter Six. On the basis of findings and conclusions made through the various Chapters, corrective measures and recommendations are forwarded in the final Chapter.
