Abstract:
The provisions for sub-division of buildings are found in the National Land Code, Act 56, 1965 but until November 1981 only five building have been sub-divided in Peninsular Malaysia. Suprisingly no buildings in the city of Kuala Lumpur hsve been issued with subsidiary titles (popularly known as Strata Titles). The main task of this paper is to make comparisons of the National Land Code with the Land Titles (Strata) Act of Singapore and Strata Titles Act 1973 of New South Wales and numerate its, inadeaquay for the present and the future. Together with this, the problems of Strata Titles in Peninsular Malaysia are also identified and possible solutions suggested. Regarding the surveying aspects there is nothing much to disuss as the boundaries of the parcels follow or are referenced to permanent structures. As such the existing procedures are included without much discussion. Finally, it si felt that the present provisions in the National Land Code should be amended, from time to time as the need arises, as a short term solution. But for a long texrm solution it is inevitable to have separate Strata Titles Act.
